Fees: The fees stated above are applicable to both domestic and foreign applicants. Fees do not cover delivery fee.
Search report will be sent by email; certificate will be sent by registered mail.

Note 1: Pre-filing search here is limited to search performed on the New Zealand Intellectual Property Office's database only.

Example 1: If you want to apply to have your trademark "ABC" registered in Class 7 (machines and machine tools etc), that is, one mark one class, the total fees for both trademark pre-filing search and registration request and certificate are:

Search: USD150
Request for registration: USD502
Certificate: USD120
TOTAL: USD772

Example 2: If you want to apply to have your trademark "ABC" registered in Class 7 (machines and machine tools etc) and Class 25 (clothing, footwear, headgear), that is, one mark two classes, the total fees for both trademark pre-filing search and registration request and certificate are:

Search: USD150+USD100 = USD250
Request for registration: USD502+USD400=USD902
Certificate: USD120+USD100=USD220
TOTAL: USD1372

Example 3 : If you want to apply to have your trademarks "ABC" and "DEF" registered in Class 7 (machines and machine tools etc), that is, two marks one class, the total fees for both trademark pre-filing searches and registration requests and certificates are:

Search: USD150+USD150=USD300
Request for registration: USD502+USD502=USD1004
Certificate: USD120+USD120=USD240
TOTAL: USD1544

Clients need to provide the following materials:

1. Name and address of the applicant: state of incorporation (where applicable).

2. Six prints of the trademark (not required for word marks).

3. List of goods/services and the class pertaining thereto.

4. Details of the basic application, if priority is claimed.

5. An English translation of any words included in the trademark of a language other than English.

6. A transliteration in Roman letters of any characters included in the trademark constituting of words being characters that are not Roman letters together with a translation into English.

7. A copy of the priority document, if priority is claimed.

Step by Step Registration Procedures:

Step 1: Clients send to Kaizen (by email or fax or post) a specimen of the trademark, a detailed list of products to be covered by the trademark and at the same time make payment for the pre-filing search to Kaizen by remittance or check;

Step 2: Kaizen conduct the pre-filing search and prepare search report and email the search reports to clients;

Step 3: (If the search results indicate that the application is likely to be accepted and clients decide to proceed) Clients make payment for the filing to Kaizen by remittance or check;

Step 4: Kaizen prepare the registration application and submit the application documents to the New Zealand Trademark Office;
 
Step 5: The Registry of Trade Marks Intellectual Property Office of New Zealand (IP New Zealand) perform examination and other procedures; if no objection received, the Registry of Trade Marks then issues the Certificate of Registration;
Step 6: Kaizen forward the Certificate of Registration to clients.

Time Scale

Currently it is taking approximately 12-20 months to get a trademark in New Zealand.

Period of Protection

10 years.
